To increase the booking chances of my child, I (the legal guardian) hereby grant the agency topmodelcast GmbH (hereinafter referred to as 'perfectlife Worldwide Modelmanagement'), which operates the model portal perfectlife Worldwide Modelmanagement www.perfectlife-models.com, the commission to present and mediate my child at my own request via an online profile / booking card for 24 months through the internet to reputable clients in the fashion and advertising industry (e.g. photographers, advertising agencies, film productions, fashion magazines, event agencies). The annual fee for membership in our agency is Euro 150.

The agency undertakes to present and mediate my child immediately upon receipt of this mediation contract. I (the legal guardian) hereby confirm the annual membership fee of Euro 150 to be paid within the next 14 days. Immediately after payment, I will receive the personal password / login for the international model portal www.perfectlife-models.com. The agency specializes in mediating baby and child models between 0 and 15 years of age.

GENERAL TERMS AND CONDITIONS OF BUSINESS

§1  BASIC PRINCIPLES/SERVICES/PLACEMENT

The agreement between the child model's legal guardian and the agency topmodelcast GmbH (hereinafter referred to as 'perfectlife Worldwide Modelmanagement') covers the following services.

Placement of the individual in response to customer enquiries, and advice regarding assignments

Personal password/login for the management of your child's images and data on our children's portal

Advice, support and support for all your questions about model business

Comp card as a PDF file to be distributed

Professional online profile/booking card with a detailed presentation

Internet rental of the online profile/booking card for the entire duration of the contract

Presentation of the online profile on the internet at www.perfectlife-models.com using a personal password

You can present and manage up to 100 photos yourself

You can amend and manage all your own personal details at any time

Picture gallery with up to 100 MB of photos

Details can be edited 24h and the online profile is visible 24h

§2  DURATION/TERMINATION

This agreement is concluded for a duration of 24 months and begins on the day that the child model's legal guardian returns the placement contract, with perfectlife Worldwide Modelmanagement to commence work immediately on receipt of the placement contract. 

§3  PLACEMENT/BOOKING

perfectlife Worldwide Modelmanagement will make every effort to place the child model with its customers for the purposes of reputable brochure and catalogue advertising, film and TV productions, as well as product advertising and fashion shows. Any contract (assignment) agreed after contact has been established is arranged directly between the child model's legal guardian and specific perfectlife Worldwide Modelmanagement customer. Any such contract agreed between a customer of perfectlife Worldwide Modelmanagement and the child model's legal guardian is not arranged by perfectlife Worldwide Modelmanagement, and cannot therefore be guaranteed. The frequency of assignments is dependent on demand for the particular model type, and so no concrete details can be provided. If the child model receives no assignments due to a lack of demand from perfectlife Worldwide Modelmanagement, this is not within the sphere of perfectlife Worldwide Modelmanagement, which accepts no liability for any form of compensation or alternative service, in particular since perfectlife Worldwide Modelmanagement is required only to make every effort to place models, but not to guarantee placement success.

§4  ASSIGNMENTS

Offers of bookings for the child model are forwarded to the perfectlife Worldwide Modelmanagement legal guardian by e-mail or telephone. Should the child model's legal guardian consider the assignment to be unacceptable, he or she is entitled to reject the assignment without providing reasons. The child model can therefore under no circumstances be forced to accept an assignment.

§5  FULFILMENT OF THE ASSIGNMENT

Where the model's legal guardian accepts an assignment from a customer of perfectlife Worldwide Modelmanagement, the child model and the legal guardian are obliged to fulfil the assignment as effectively as possible. Other than in the event of force majeure (accident, illness), if the child model/legal guardian fails to attend the assignment at the agreed time, or is late, perfectlife Worldwide Modelmanagement is entitled to dissolve this agreement with immediate effect without providing reasons. perfectlife Worldwide Modelmanagement is further entitled to dissolve the contract immediately prior to the expiry date if the child model's legal guardian is in breach of important terms and conditions of the contract.

§6  OWN ASSIGNMENTS

perfectlife Worldwide Modelmanagement permits models to work for other model agencies and accept their assignments, or reputable assignments which the model has arranged personally.

§7  PRESENTATION

The child model's legal guardian expressly consents to the online publication of the child model's photos and details for customers of perfectlife Worldwide Modelmanagement at www.perfectlife-models.com, or on any other website operated by perfectlife Worldwide Modelmanagement. However, perfectlife Worldwide Modelmanagement undertakes to treat the child model's details in confidence, and to make these visible only to its customers. This is in accordance with applicable data protection legislation.

§8  COURT OF JURISDICTION

The court of jurisdiction is Linz  Austria

§9  PARTIES TO THE CONTRACT

By returning this form, the child model's legal representative (legal guardian) confirms that he/she has read and agrees with all the articles of the contract.

§10 ADDITIONAL AGREEMENTS

Additional agreements and amendments to the agreement are not valid unless they are made in writing, and must also be rescinded in writing.

§11 COMMISSION/BOOKING FEE

If the event of a successful placement, the child model's legal guardian does not pay a separate booking fee, meaning that the full booking payment is paid to the child model's legal guardian. The child model’s booking fee is dependent on the assignment. Your child can expect to receive between 300 and 550 euro per day and assignment. In addition to the booking fee, the customer will reimburse the child model’s legal guardian for all expenses incurred (e.g. actual travel costs, any overnight accommodation required  for up to 2 legal guardians, plus other expenses)

§12 ACCOMPANYING MINORS

A legal guardian must accompany child models to the confirmed assignment, and must be in attendance throughout the assignment.

§13 COSTS

The annual fee for membership in our agency is Euro 150.

§14 CHOICE OF PHOTOS/OWN PHOTOS

The legal guardian is personally responsible for the child's selection of photos. We recommend using only highly respectable, flattering or professional photos (taken by a photographer, assignment photos, good photos you have taken yourself). The legal guardian agrees not to present photos on which the child is not dresses, or wearing very little.

§15 PAYMENT METHODS (The annual fee for membership)

The legal guardian agrees to pay the EUR 150 fee for placement via the online portal at www.perfectlife-models.com within the next 14 days.

§16 RIGHT OF RESCISSION

topmodelcast GmbH will be obligated to start immediately with the presentation and placement of the child model at the child model guardian’s own request after receipt of the agency contract and to perform all services completely in accordance with the contract.

Clients who are consumers have the right to rescind a remote sales/agency contract concluded outside of offices within 14 days without specifying reasons. The rescission period will commence upon the date of conclusion of the contract. However, the consumer will not have a right of rescission where the agency topmodelcast GmbH started with performance of the contractual services before expiration of the rescission period and then fully performed the services at the consumer’s own request. 

In order to exercise his right of rescission, the consumer must rescind the contract in a clear rescission declaration by mail or e-mail, stating his name, address as well as the booking code. The deadline will be deemed to have been duly met where the declaration is sent in good time before expiration of the 14-day period.

Where the consumer exercises his right of rescission and services were performed before expiration of the rescission period by topmodelcast GmbH at the consumer’s request, he will be obligated to pay adequate remuneration for the services performed up until that time.

The right of rescission is also being granted to clients who are not consumers, but in this case the client will be charged a cancelation fee of 50 Euros in addition to the adequate remuneration.

§17 CONCLUDING PROVISIONS

As soon as payment of the administration contribution is received, the child model's legal guardian receives an e-mail containing the password/login for the online portal www.perfectlife-models.com
